Prior to accessing or using this website, "Dink Flamingo's Amateur Straight Guys" located and hosted at the Uniform Resource Locator (URL): www.amateurstraightguys.com, (the "Site", "We" or "Us"), you, the website user ("You", "User" or "Member") must agree to ALL of the conditions in these Terms Of Service which were last modified on July 1, 2018 which hereby form a binding agreement (the "Agreement") between You, the User and Us, the Website, "Dink Flamingo's Amateur Straight Guys" located and hosted at the Uniform Resource Locator (URL): www.amateurstraightguys.com.

These Terms Of Service also govern your MEMBERSHIP to the Site if You become a Member. By accessing, using, viewing, reading, printing, installing, or downloading any material from the Site, or becoming a Member to the SITE, You agree to be bound by these Terms and Service.

You are solely responsible for obtaining access to the Site and that access may involve third party fees (such as Internet Service Provider charges, bandwidth charges or overages charges, airtime charges and/or data charges by your provider if using a mobile device such as a cellular telephone or tablet). You are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, You must provide and are responsible for all equipment necessary to access the Site.

This Terms Of Service document may change at any time without notice. It is the responsibility of the USER to periodically revisit this Terms Of Service document to check for any changes, additions or deletions. The date of the last modification to these Terms Of Service was July 1, 2018. Any User who becomes a Member will be bound by the Terms Of Service document in effect at the time they become a Member of the SITE for a period of 30 days thereafter. After 30 days from the date they become a member, they will be bound by any modifications to this document

I. Age of Majority and Membership

A. Age of Majority

You represent and warrant you are at least 18 or 21 years of age, depending on the age of majority in your jurisdiction, and that you have the legal capacity to enter into this Agreement. If you are not at least 18 or 21 years of age, depending on the age of majority in your jurisdiction, you must exit the SITE immediately and may not use or access the SITE or print or download any Materials from them. You may be asked to verify your birth date on the Birth Date Verification form as a condition of entry onto the SITE, pursuant to 28 U.S.C. §1746. You agree not to bypass any security and/or access feature on this SITE. Additionally, the SITE does not assume any responsibility or liability for any misrepresentations regarding a user's age.

B. Membership

Membership may not be assigned, transferred, or sold to a third party. The SITE and its affiliates disclaim any and all liability arising from fraudulent entry and use of the SITE. If a user fraudulently obtains access, the SITE may terminate membership immediately and take all necessary and appropriate actions under applicable federal, state, and international laws. No refunds either partial or otherwise will be issued under such circumstances and legal action may be taken against USERS engaging in fraudulent activity of any kind.

II. Access to, Limited License, and Interference with, SITE

A. Access

To access the SITE or some of the resources it has to offer, you may be asked to provide certain registration details or other information. It is a condition of your use of this SITE that all information you provide will be correct, current, and complete. If the SITE believes the information you provide is not correct, current, or complete, the SITE has the right to refuse you access to the SITE or any of its resources, and to terminate or suspend your access at any time.

B. Limited License

Subject to these Terms and Conditions and in consideration of using the SITE, the SITE hereby grants you a limited, nonexclusive, nontransferable personal license to access and use the SITE and the Materials contained therein. The SITE provides the Materials on this SITE for the personal, non-commercial use by viewers, fans, visitors, subscribers and/or potential subscribers of said SITE. Users of this SITE are granted a single copy license to view Materials (on a single computer or device only). All Materials on the SITE shall be for private non-commercial use only, and all other uses are strictly prohibited. The SITE reserves the right to limit the amount of materials viewed. If We find your account to be excessively downloading files (more than five (5) videos within a 24-hour period) we may restrict your download abilities for a period of 24 hours. If we deem your account to be abusing this download policy repeatedly we may cancel your Membership at our discretion without refund. You agree to prevent any unauthorized copying or downloading of the SITE, or any of the materials contained therein. Any unauthorized use of the SITE or any of the materials contained therein terminates this limited license effective immediately. This is a license to use and access the SITE for its intended purpose and is not a transfer of title. You represent and warrant that you will not allow any minor access to this SITE and that you will not copy or redistribute any of the content appearing on this SITE. SITE reserves the right to terminate this license at any time if you breach or violate any provision of this Agreement, in which case you will be obligated to immediately destroy any information or materials you have downloaded, printed or otherwise copied from this SITE. Violators of this limited license may be prosecuted to the fullest extent under applicable law. All of our videos are invisibly "watermarked" with a unique string of numbers at the time of download that is assigned to the Username that downloads the video. This allows us to track the Username that originally downloaded any video file. When any of our videos are found on file sharing sites, this invisibly assigned number is tracked back to the associated Username and that Username is deleted from our system without forewarning or refund. Furthermore, the individual who's information was used to purchase the Membership associated with that Username may be prosecuted for breach of this Agreement and infringement of our rights related to the material.

C. Interference

Except where expressly permitted by law, you may not translate, reverse-engineer, decompile, disassemble or make derivative works from our SITE's Materials. User hereby agrees not to use any automatic device or manual process to monitor or reproduce the SITE, and will not use any device, software, computer code, or virus to interfere or attempt to disrupt or damage the SITE or any communications on it.

III. Membership

A. Registration

You may access the non-public portion of the SITE (Password Protected Members Area) only by being a Member in good standing to the SITE. The SITE reserves the right to modify Materials and the SITE's design at anytime, with or without prior notice. You may become a member of the SITE by completing an online registration form, which must be accepted by SITE, and you must pay the subscription fee for the type of Membership Subscription you choose. Upon submission of the online registration form, SITE or its authorized agent will process the application. In connection with completing the online registration form, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the registration form (such information being the Registration Data) and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete at all times while you are a Member. Giving false Registration Data on the registration form may result in your Membership being denied or declined or your Membership being canceled immediately without refund. The provider for your form of payment may also be notified of a fraudulent transaction attempt. Furthermore any transaction deemed as fraudulent may result in your information being placed in a Fraud Database, preventing you from making other online purchases that access this Fraud Database while processing transactions.

B. Trial Membership

All trial Memberships will automatically become a regular recurring monthly Membership Subscription at the end of the trial period unless You cancel before the trial period ends. All regular recurring monthly Membership Subscriptions will automatically renew each month until canceled. Trial membership content access may be limited depending on the type of trial membership you choose. To receive access to all site content it may be necessary to upgrade the trial membership to a full price site subscription.

C. Member Account, Password and Security

As part of the registration process, you will be issued or allowed to choose a unique user name and password which you must provide in order to gain access to the non-public Members Area portion of the SITE. You certify that when asked to choose a username you will not choose a name which may falsely represent you as somebody else or a name which may otherwise be in violation of the rights of a third party.

D. Membership Fees

Subscriber's subscription to the service will be automatically renewed as stated on the terms of the billing form upon expiration of the initial term, unless SITE subscription is cancelled via our billers. Membership fees to the SITE are displayed prior to your subscription thereto. You agree to pay all membership fees when due according to these billing terms.

E. Confidentiality

Please see our Privacy Policy for information regarding all the ways we use or may use your information. However, we will NEVER SELL or SHARE your Information.
